Does anyone have practical experience with gambling in Spain (poker, casino, sports betting)? I'm particularly interested in taxation of both gambling operators and the customers (gamblers).

Well, taxes in Spain are quite high... So I do not recomend to register you business there, also, getting liscenses and other type of permissions can be a nightmare . Most of the online Casinos that operate in the spanish market are registered in Gibraltar. Check out the liscense of Codere and where is registered.
 
Yes, I agree with you but I don't know exactly the % of taxes and prices. I don't want to fool you

so basically you're saying that it's like any other income and you have to pay tax from it even if you risk your already taxed money?
if one has no other income in Spain which rate it would be?

is it applied to the net profit (winning minus loses)? nothing else makes sense actually, so just to confirm

what if one isn't a tax resident in Spain but makes some money in casino or betting sports while being in Spain on holiday?

Winnings from casinos, betting shops etc. registered in European Economic Area are tax free. This is granted in the European Community Article 49; "Free movement of persons, services and capital".

There are several court judgements in support of that, but with quick googling I could find only this: A Finnish woman won in a Swedish lottery, and later won her case against a greedy taxman. The gambling operator needs to pay taxes in the country it is registered in. Customers do not pay any tax on their winnings,

Speaking about casinos and sports betting this is not true for example in France or Latvia.
In many countries winnings from Lotteries are not tax free.

And yes, it's difficult to find relevant information one can rely on.
 
Ok, I was clearly embarrassingly wrong. I really thought gambling winnings are tax free all over Europe, as Art. 49 is often invoked in this case. Every day, learn something new.

I wonder how these tax rules would fare if challenged in a EU court. Especially Latvia seems to exclude winnings from their own state gambling operator, but tax winnings from other licenced operators.

I know about that - my point was that Spanish tax authorities can be obviously pretty aggressive and I haven't found any reliable source that clears things up for me enough - it's simply chaos

say I'd rent a flat in Spain, get NIE, get registered on the address at the police
going to casinos or betting online on Spanish sites while spending only a few months during the year in Spain and being still a tax resident of another EU country I'm still not sure if the winnings are safe

thanks for your input, it's really welcome, however I'm not thinking that complex without a good reason
it's not about me personally - more people involved
we need an access to several Spanish services in gambling industry that require NIE and local address for registration (which requires a supportive documentation, etc.)
also all that bother is not for winning 1k in roulette in some resort casino on the coast - that's why I need to understand the related taxation matters
